Prosecutors from the National Anticorruption Directorate - Constanta Territorial Service ordered the indictment, without being detained, of the defendant Nicusor Daniel Constantinescu, President of the Constanta County Council, who was charged with the offense of repeated abuse of official capacity.
In the indictment, prosecutors stated the following facts: "In the period 2009 - November 27, 2013, defendant Daniel Constantinescu Nicusor knowingly and exercising the duties as President of Constanta County Council, repeatedly failed to fulfill or improperly fulfilled obligations under Article 76 of Law nr.446/2006".
Thus, according to the public position held, the defendant did not provided funding for the Military Centre of Constanta, did not carry the necessary repairs at its headquarters and ordered the dissolution of contracts for the provision of utilities and security services required for normal functioning of the institution.
Nicusor Constantinescu also tried several times to evacuate the institution, causing violation of the rights and legal interests of the Ministry of Defense as well as damage to the institution.
The activity of the Military Center of Constanta was thus seriously disturbed due to lack of means of communication, utilities and security services after termination, by the defendant, of the contracts under which they were provided.
The file was sent to the Bucharest Court of Law, with the proposal to maintain the judicial control measure ordered against the defendant Nicusor Constantinescu Daniel.
We mention that this stage of the criminal process is, according to the Code of Criminal Procedure, the completion of the criminal investigation and the indictment is sent to court for trial, a situation that cannot overcome the benefit of the doubt.
