How much is a policeman?

Constanta's Court of Law decided yesterday, after six hours of hearings and another our of debates, the preventive detention for a period of 29 days, of 11 junior officers from the Police Service Road Constanta. The accusations are for taking bribe, traffic of influence, abuse in service, the usage of information which are not given to publicity and intellectual false.

Beside them, there were arrested 3 civilians, who played the role of "intermediaries". One of the sums of money which it is supposed to have demanded one of the junior officers is of 150 Ron. The names of the cops who, say the prosecutors, sold themselves to the offenders are: Gigi Cristian Ruşescu, Daniel Andrei Mircea, Elvin Cadîr, Dumitru Iulian Maxim, Enis Vuap, Andrei Bogdan Călugăru, Cosmin Cristian, Paul Mihai Ciolpan, Marius Ivan and Cristina Gherlan. The civilians arrested along with these are: Gigel Budur, Alin Bogdan Drughe and George Guliu.

Jammed in the arrested box

After marathon hearings at the Prosecutor's Office near the Court of Law in Constanta, the 14 suspects were brought in court, in the night from Thursday to Friday at around 2 o'clock being presented to the judges with the proposal of preventive detention. The session started at 2:30 in the council room. After a few hours of hearings in which the suspects stand up in the arrested box, the court demanded water and benches for the indicted.  In all this time, their families waited on the halls of the court. Six hours later, at 8.30 in the morning, the full court has withdrawn for deliberations. In front of the magistrates of the Constanta's Court of Law all 14 declared that they are innocent. They said they didn't know what were they charged for and put all their hopes on their lawyers to pull them out of this situation. At 9.30 the sue hall was again crowded: the 14 suspects were put at their box, and their relatives occupied the sits on the benches. In the public session, the judge who analyzed the case quoted the decision: "In the name of law, he rejects the proposals." In unison the families of the accused shouted their gratitude towards the court. But their joy was premature "in the name of law, rejects the proposals of the lawyers. He admits the proposal of the prosecutors' office. He disposes the preventive arresting for 29 days". The despair got to all that were in the room and the tears of the wives, mothers and fathers of the ones who were in the box could not be retained. Asked if they will try an appeal against the decision of the court, all the indicted answered affirmatively. The appeal will be trialed at the Court of Appeal, in a three days time. 

Who bought the cops?

Through the most serious accusations brought to the investigators are those who regard the policemen Daniel Andrei Mircea, Elvin Cadîr şi Enis Vuap. According to the investigators the three were a real support to Marian Alexandru Lupu, one of the six suspects of robbery committed in November, at Hârşova. The prosecutors say that the three of them alerted Lupu that he is one of the suspects and told him that his car was given as instruction. Moreover, they told him where the police crews in the City of Constanta were and canceled a report of contravention for a near one of Marian Lupu. And the help given to him doesn't stop here. Elvin Cadîr helped the suspect hide an undeclared accident. Also through the help given by the policemen, Lupu supported a cousin. In exchange of this favor, agent Daniel Andrei Mircea demanded 150Ron. Marian Alexandru Lupu, the one who the prosecutors say "he bought" the influence of the policemen, is qualified as" young enterprising". At the age of 21 he is the only shareholder of Tase Autotrans SRL, and he deals with, according to official dates, ruttier merchandise transports. Alexandru Lupu is the only partner of the company and its administrator. In 2007 the company had two employees and a gross profit of 101.021 Ron. . Dyr Trans 2008 SRL is also in charge with ruttier merchandise transports and has as partners Tănase Lupu and Marian Alexandru Lupu, each with 50%. Marian Lupu occupies the position of administrator.

The prosecutors have asked the preventive detention of the policemen and the civilians, saying that the punishment for their action is jail for a period bigger that 4 years and letting them free represents a concrete danger for the public order. „These" said the prosecutors, „are the persons who take part of the system, have knowledge upon the means the judiciary organs dispose for admitting and proving crimes and because of these developing crimes they took prevention measures, confidential ones, proving they are inventive and determined in solving the problem and the modality of solving it". Moreover the investigators showed that they were using different codes to communicate" so that the unauthorized persons do not have the immediate possibility to understand the real purpose of the messages transmitted between the indicted.". The representatives of the prosecution offered examples in this sense: „Give to Aurel Vlaicu, without PP", „Erase the chessboard, do the big castling", „We drink a coffee later", „Did you solve the math's exercise?" Moreover the prosecutors affirmed that „the activity of the indicted is extremely dangerous because they have no scruples in faking blood samples, falsifying criminal files with the scope of removing from the penal crime the real authors". The reason which stood at the base of all these is „ enriching through fraudulent means" affirmed the prosecutors. To make the court admit the proposal of preventive arrest, the representatives of the court said that „ exists already the opinion in which through judiciary police agents there is a caste that solves anything, through all means looking for the intervention in the benefit of the criminals or of the crimes, using intermediaries so that the usage to be obtained from the buyer of influence". The prosecutors accused the suspects of trying to prevent the knowing of the truth and that they prepare for making another crime. The court needed appreciatively 60 minutes to appreciate the danger these policemen and the civilians retained represented. At the end of the debates the decision was in the favor of the so called people of law.
